Welcome to Thankful Hearts of Texas Inc. ("we," "our," or "us"). By accessing and using our website located at thankfull.org (the "Site") and any related services, features, content, or applications (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms").

These Terms constitute a legally binding agreement between you and Thankful Hearts of Texas Inc. If you do not agree to these Terms, you must not access or use our Services.

2. About Our Organization

Thankful Hearts of Texas Inc. is a 501(c)(3) nonprofit organization dedicated to empowering and enriching the lives of disadvantaged children in Fort Bend County by supporting their academic, social, and emotional development. Our mission is carried out through various programs including:

Classroom Readiness Program
Providing backpacks, school supplies, and educational materials to ensure children start the school year prepared and confident.
Hearts of Hope Family Support
Offering immediate assistance to families facing crisis through care packages, essential household items, and emotional support.
Teacher and School Partnership Initiative
Supporting educators with classroom resources, appreciation events, and motivational programs.
Celebration of Giving Program
Hosting classroom celebrations and gift drives during holidays and special moments.

3. User Accounts and Registration

3.1 Account Creation

Certain features of our Services may require you to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately if you discover or suspect any security breaches
  • Take responsibility for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Services if:

  • You provide any information that is inaccurate, not current, or incomplete
  • We have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete
  • You engage in any conduct that violates these Terms or applicable laws

4. Donations and Financial Transactions

4.1 Donation Processing

All donations made through our Services are processed securely through our third-party payment processors. By making a donation, you represent and warrant that:

  • You are authorized to use the payment method provided
  • The information you provide is accurate and complete
  • You will be charged the amount you specify at the time of donation
  • Donations are generally non-refundable

4.2 Recurring Donations

If you elect to make recurring donations, you authorize us to charge your payment method on a recurring basis until you cancel your recurring donation. You may cancel recurring donations at any time by contacting us or through your account settings.

4.3 Tax Deductibility

Thankful Hearts of Texas Inc. is a recognized 501(c)(3) nonprofit organization. Donations may be tax-deductible to the extent permitted by law. We will provide donation receipts for all contributions, which may be used for tax purposes.

5. Intellectual Property Rights

5.1 Our Content

All content on our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Thankful Hearts of Texas Inc. or our content suppliers and is protected by United States and international copyright laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes. This license does not include:

  • Any resale or commercial use of our Services or content
  • Collection and use of any product listings, descriptions, or prices
  • Any derivative use of our Services or content
  • Any use of data mining, robots, or similar data gathering and extraction tools

5.3 User Content

By submitting content to us (including but not limited to stories, photos, comments, or other materials), you grant us a perpetual, royalty-free, non-exclusive, worldwide license to use, modify, display, and distribute such content in connection with our charitable mission.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Using our Services for any illegal purpose or in violation of any local, state, national, or international law
  • Harassing, threatening, intimidating, or impersonating any person
  • Posting content that is hateful, threatening, or pornographic
  • Violating the security of any computer network, or cracking any passwords or security encryption codes
  • Running Maillist, Listserv, or any form of auto-responder or "spam" on the Services
  • Using manual or automated software, devices, or other processes to "crawl" or "spider" any page of the Site
  • Interfering with the proper working of the Services or any activities conducted on the Services
  • Bypassing measures we may use to prevent or restrict access to the Services

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THANKFUL HEARTS OF TEXAS INC. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS, (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THANKFUL HEARTS OF TEXAS INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

11. Indemnification

You agree to defend, indemnify, and hold harmless Thankful Hearts of Texas Inc. and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Services
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights
  • Your violation of any applicable law, rule, or regulation
  • Any content that you post or otherwise transmit through the Services

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in Fort Bend County, Texas, in accordance with the rules of the American Arbitration Association.

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You acknowledge and agree that you are waiving the right to participate as a plaintiff or class member in any purported class action or representative proceeding.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

14. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
